1. Acceptance of Terms

Welcome to threecreeksbrokenbow.com, owned and operated by Three Creeks Reserve. By accessing or using this Site, including browsing cabin listings, making a reservation, subscribing to our mailing list, or accessing the Owner Portal, you agree to be bound by these Terms of Service. If you do not agree to these Terms, please do not use the Site. We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

2. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates applicable local, state, federal, or international law
  • Attempt to gain unauthorized access to any portion of the Site, including the Owner Portal or other users’ accounts
  • Interfere with or disrupt the operation of the Site or servers/networks connected to it
  • Use any automated system (bots, scrapers, etc.) to access the Site without our prior written permission
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity

3. Cabin Reservations and Bookings

3.1 Booking Process

The Site allows you to browse available cabin rentals and complete bookings directly, including providing payment information and submitting deposits or full payment for your stay.

3.2 Accuracy of Information

You agree to provide accurate, current and complete information when making a reservation, including guest counts, contact details, and payment information. Three Creeks is not responsible for booking errors resulting from inaccurate information provided by you.

3.3 Payment

All bookings made through the Site require payment via the methods presented at checkout. By submitting payment, you authorize Three Creeks (or its designated payment processor) to charge the provided payment method for the total reservation cost, applicable taxes and any fees disclosed at the time of booking.

3.4 Cancellations, Refunds, and Changes

Cancellation policies, refund eligibility and any fees associated with changing or canceling a reservation will be disclosed during the booking process. 

3.5 Rental Rules

Guests are expected to comply with all property rules and guidelines provided at booking or upon arrival, including occupancy limits, pet policies and noise restrictions. Three Creeks reserves the right to refuse service, cancel a reservation, or remove a guest from the property for violation of these rules.

4. Newsletter and Communications

By subscribing to our mailing list, you consent to receive promotional emails, offers and updates from Three Creeks Reserve. You may unsubscribe at any time using the link provided in any email communication. We do not sell or rent your email address to third parties.

5. Owner Portal

Property owners with access to the Owner Portal are responsible for maintaining the confidentiality of their login credentials and for all activity that occurs under their account. Notify us immediately if you suspect unauthorized access to your account. Access to the Owner Portal is provided through our third-party property management platform, and use of that portal may also be subject to that provider’s separate terms.

6. Intellectual Property

All content on the Site, including text, graphics, logos, images, photographs and software — is the property of Three Creeks Reserve or its licensors and is protected by applicable copyright, trademark and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

7. Third-Party Links and Services

The Site may contain links to third-party websites or services (such as payment processors, booking platforms, or social media) that are not owned or controlled by Three Creeks Reserve. We are not responsible for the content, privacy practices, or terms of any third-party sites. Your use of any third-party site is at your own risk and subject to that site’s own terms and policies.

8. Disclaimer of Warranties

The Site and all content, bookings, and services made available through it are provided “as is” and “as available,” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the fullest extent permitted by law, Three Creeks Reserve and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site or any booking made through it, even if advised of the possibility of such damages.

10. Indemnification

You agree to indemnify and hold harmless Three Creeks Reserve, its owners, employees and affiliates from any claims, damages, losses, liabilities and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Broken Bow, Oklahoma.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary and the remaining provisions shall remain in full force and effect.
